    “Saskatoon Appeals Board Upholds Height Limit on Luxury Home”

    The Saskatoon development appeals board upheld regulations regarding a house in Nutana that exceeded height limits. The board stated that granting leniency would go against zoning laws. The three-story house on University Drive, valued at $1.6 million, surpassed the maximum height allowed for established neighborhoods by 1.4 meters and also exceeded width restrictions. Violations were discovered during an inspection in May when the city issued a stop work order as the construction neared completion.

    The current owners, Curtis and Rachelle Kelln, who acquired the property from the late developer Karl Miller’s estate, were unaware of the size violations. City inspections during construction and after completion did not uncover the discrepancies, leading to the appeal.

    Jonathan Naylor, president of the Varsity View Community Association, supported the board’s decision, emphasizing the importance of regulations to prevent oversized homes that can impact neighboring properties. While pleased with the ruling, Naylor raised concerns about oversight by the previous owner and city inspectors.

    Douglas Tompson, a neighbor, acknowledged the homeowners’ innocence in the situation and expressed worry about unresolved issues. Speculation arose about potential legal actions following the board’s decision. The Kellns refrained from commenting on their next steps, considering options after exploring the challenges of altering the house structure. The decision by the development appeals board can be appealed to the Saskatchewan Municipal Board within 30 days.
